Car Accidents

Being in a car accident is a terrifying experience. If you are injured in the accident, the stress that comes after the accident can be overwhelming. Most people assume that if they are in an accdient and it was someone else's fault, that person's insurance will cover the medical bills. What most people don't know is that the at fault driver's insurance company has no responsibility to pay for your injuries until the claim is settled. That can take anywhere from six to eighteen months and if you have been severely injured, that's a lifetime. While we may not be able to make the process go any faster for you because it depends upon how fast you heal, we can use our experience and expertise to make sure that when it does come time to end your case, you are in the best position possible. We have found that when people are freed from having to deal with the excessive expectations of the insurance companies, they are more easily able to focus upon what's important...themselves.

Time Limits

There are time limits for you to conclude your case after a car accident. Generally, after a car accident, you have three years to either settle your case or sue the person who injured you.  There are also differing time limits too numerous to mention here for you if you have been injured in accidents that are not automobile related. If you have been injured due to the negligence of another person and not the result of a car accident, you need to keep in mind that these limitations can be as low as a year for you to file a lawsuit. If you are in such a position, you should seek legal information to help you determine how long you have to assert your rights.

Evaluating Your Claim

Insurance companies require a lot of information in order to evaluate your claim. If you try to handle your case yourself, they may tell you that they want you to provide them with medical bills and then offer you the cost of those bills plus an additional amount of money for "pain and suffering". What the adjuster likely won't do is tell you all of the rights you have to be compensated for the effects the other driver's negligence had on your life. To adequately evaluate a case, you must have all of the medical bills and then take into account all other economic losses that you have suffered as a result of this accident. Did you have to take sick time from work? Did you have to rent a car? How many miles did you have to drive time and time again to go to medical appointments? These are all examples of costs that are coming out of your pocket that you should be compensated for. In addition, the toll your injury has had on your family and private life must be taken into account as well. These are called non-economic damages and they include pain and suffering, loss of enjoyment of life and inconvenience, just to name a few. Whatever you do, don't simply let the insurance adjuster tell you how you should be compensated for the injuries you suffered. If you want to handle the case yourself, please take a look at our consumer section to get some ideas for handling your case. If you want to consult with an attorney, contact us today. Truck Accidents

truck accidentsAccidents which are the fault of a professional truck driver involve a whole host of issues outside of the normal personal injury claim. Because they are professional drivers, they are specially licensed to operate large trucks. This also means that there are many regulations which must be obeyed by truck drivers.  Because of the significant expertise required to evaluate these types of cases, we recommend that you not attempt to settle a case on your own without, at a minimum, consulting with an attorney. Feel free to contact us. Our initial consultation is free and we can help you decide what course to take in making sure that you are protected.

Motorcycle Accidents

motorcylcle accident

Motorcyclists are among the most vulnerable users of our roads. 98% of motorcycle accidents result in injury to the motorcyclist involved. And 66% of all motorcycle accidents occur due to the motorcyclist’s right of way being violated by another vehicle.

This means that if you’ve been involved in an accident where you were riding a motorcycle and there was another vehicle involved, you might have a legal claim. This even includes accidents when there was no contact made between the motorcycle and the vehicle at fault. Many times a vehicle will violate the motorcyclist’s right of way without making contact with the motorcycle, forcing the motorcyclist to swerve and crash. Motorcyclists can still be owed compensation in situations where a motorcyclist crashes while trying to avoid contact with a negligent driver.

Motorcycle accidents can result in significant injuries such as fractures and shattered bones to severe injuries that can change your entire life like traumatic brain injuries. In brain injury cases especially, it is important to not only hire an experienced motorcycle attorney but also one with a strong background in traumatic brain injuries.

Beyond paying for any injuries you may have sustained, you may be entitled to compensation for the following.

  • Vehicle damage
  • Permanent disability
  • Lost wages from work
  • Rehabilitation
  • Punitive damages
  • Pain and suffering
  • Psychological treatment and counseling

It is important to obtain legal counsel if you’ve been involved in a motorcycle accident. If you’ve been injured in a motorcycle accident in the Colorado Springs area, contact the experienced motorcycle accident attorneys at Jaray & Webster today!

Pedestrian Accidents

pedestrian accidentsBeing struck by a car or truck can often have devastating consequences. Initially, you will need to determine who will pay your medical bills. In most cases, the person driving the car or truck should be responsible for your medical bills and their insurance company may have coverage to pay for your treatment. If not, you should check with your own insurnace company to determine whether there is medical payment coverage as part of your policy. In cases of serious long term injuries, it may be helpful to consult with an attorney prior to discussing a settlement.

Slip and Fall Accidents

slip and fallAccidents happen when you least expect them. That is why they call them accidents. But sometimes they are caused by someone else's negligence. In order to have a valid claim, in most cases you will need to have proof that the property owner had notice of a dangerous condition and failed to take reasonable steps to correct the situation. It is often very helpful to take pictures of where you were injured as soon as possible. In some cases, the property owner may have medical payment coverage which can be used to pay for your medical treatment. You should generally ask the owner or manager of the property to give you the name of their insurance company so you can file a claim and determine whether medical payment coverage is available. In cases of more serious injury, our law firm may be able to help you obtain the compensation to help repair the harms and losses.

Cell Phones and Car Accidents

In the United States, there are over 260 million cell phones in use. The cell phone has become a pervasive device. The problem with the cell phone, however, is that it can cause great distractions when driving. Recent studies have shown that drivers are more of a hazard to others on the road when texting or talking on their cell phone than drivers with a blood-alcohol content of .08.

Beyond that statistic, there are now laws that limit cell phone use when operating a vehicle in Colorado. As of December of 2009, it is illegal to text and drive in the state of Colorado. Furthermore, drivers under the age of 18 aren’t allowed to talk on their cell phones while driving. The only instances when someone under the age of 18 can legally use a cell phone while driving is in the case of an emergency, road hazard, or to report improper conduct by another driver.

Using a cell phone improperly while driving results in a $50 fine for your first offense. The second offense results in a fine of $100. While these penalties are small by themselves, an accident caused by a person texting and driving can cost much more. And if you have been hurt in an accident by someone using their cell phone when driving, you may have a case.

If you or a loved one has been injured by someone using their cell phone while driving, please contact the Colorado Springs personal injury attorneys at Jaray & Webster today.
