Permanent Disability

Permanent Disability benefits are paid after the doctor indicates that you have reached maximum medical improvement (MMI). At that time, the doctor will give you a percentage impairment rating.

This rating will be converted into dollars. If you are given a whole person rating, a formula is used. If you injure your arms or legs, a schedule of impairments table may be used. It is important to contest the impairment rating within 30 days of receipt of a final admission of liability. If you are unable to return to any work, you may be entitled to receive permanent total disability (PTD) benefits. It is usually best to contact an attorney to discuss your rating and what options you have to pursue a proper permanent disability award.
